These Terms of Service ("Terms") govern your use of the HealthcareSeeker website at healthcareseeker.com (the "Site"), operated by HealthcareSeeker ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About HealthcareSeeker

HealthcareSeeker is a healthcare insurance comparison and lead generation platform. We provide educational content about health insurance options — including ACA marketplace plans, short-term health insurance, fixed indemnity plans, supplemental insurance, and other coverage types — and connect consumers with licensed insurance agents and insurance partners who can assist with enrollment.

We are a free service for consumers. We earn compensation from our insurance partners when you submit your information through our forms or enroll in a plan through one of our partners. This compensation model is described in our Advertising Disclosure.

2. We Do Not Sell Insurance

HealthcareSeeker is not an insurance company, insurance agent, or insurance broker. We do not:

  • Sell, issue, bind, or underwrite any insurance policies
  • Provide insurance quotes or guarantee any specific premiums, benefits, or coverage
  • Make enrollment decisions on your behalf
  • Act as your agent or representative in any insurance transaction

When you submit your information through our Site, we connect you with licensed insurance agents and our insurance partners who can provide you with actual plan options and enrollment assistance. Any insurance policy you purchase is between you and the insurance carrier, not HealthcareSeeker.

3. Not Medical or Financial Advice

The information on this Site is provided for general educational and informational purposes only. It does not constitute:

  • Financial advice — consult a financial advisor for financial planning decisions
  • Legal advice — consult an attorney for legal questions

4. Eligibility

You must be at least 18 years of age to use this Site and submit information through our forms. By using the Site, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

Our Site is intended for use by residents of the United States (50 states and the District of Columbia). We do not provide services for US territories or international users.

5. Your Use of the Site

You agree to use the Site only for its intended purpose: researching health insurance options and requesting to be connected with licensed insurance agents. You agree to:

  • Provide accurate, truthful, and complete information in any forms you submit

6. Form Submissions and Lead Generation

  • Your information is shared with one or more of our insurance partners, including QuinStreet, MediaAlpha, EverQuote, eHealth, Agile Health Insurance, and licensed insurance agents in their networks
  • One or more licensed insurance agents may contact you by phone, email, or text message to discuss your coverage options
  • We may receive compensation from our partners for sharing your information — this is how we keep the service free for you
  • Your information may be shared with multiple partners simultaneously (a "shared lead") unless otherwise specified
  • We do not guarantee that any particular plan, price, or carrier will be available to you — actual availability depends on your location, age, income, health status, and other factors

By submitting a form, you acknowledge that you are requesting to be contacted about health insurance options and that you understand your information will be shared as described in our Privacy Policy.

7. Consent to Be Contacted

By checking the consent checkbox and submitting a form on our Site, you provide your prior express written consent under the Telephone Consumer Protection Act (TCPA) to be contacted by HealthcareSeeker and the specific insurance partners identified on the form, at the phone number you provided, including via:

  • Automated telephone dialing systems
  • Pre-recorded or artificial voice messages
  • Text messages (SMS/MMS)
  • Email

You understand and agree that:

  • This consent is not a condition of purchasing any product or service
  • Message and data rates may apply for text messages
  • You may revoke your consent at any time by: replying STOP to any text message, calling us, or emailing privacy@healthcareseeker.com
  • Revoking consent does not affect communications already in progress at the time of revocation

If you do not consent to be contacted, do not submit the form. You may still browse our Site and educational content without submitting any personal information.

8. Accuracy of Information You Provide

You agree to provide accurate and truthful information in all forms. Submitting false, misleading, or fraudulent information is a violation of these Terms and may result in:

  • Rejection of your lead by our insurance partners
  • Inaccurate plan recommendations or subsidy estimates
  • Termination of your access to the Site
  • Legal action if false information is submitted with fraudulent intent

9. Cost and Plan Data Disclaimer

The healthcare costs, insurance premiums, subsidy estimates, plan comparisons, and other financial information displayed on this Site are:

  • Estimates only — actual costs vary by location, age, health status, carrier, plan selection, and other factors
  • Based on publicly available data from sources including the Centers for Medicare & Medicaid Services (CMS), Kaiser Family Foundation (KFF), FAIR Health, Healthcare Cost and Utilization Project (HCUP), and Medical Expenditure Panel Survey (MEPS)
  • Subject to change — insurance premiums, benefits, carrier availability, and regulations change annually and may differ from what is displayed
  • Not guaranteed — we do not guarantee that any specific premium, subsidy amount, deductible, or out-of-pocket cost will be available to you

The out-of-pocket maximum figures cited on this Site ($10,150 individual / $20,300 family for 2026) are set by CMS in the annual Notice of Benefit and Payment Parameters. These limits apply to ACA-compliant plans only and may be adjusted annually.

Subsidy estimates are based on current law, including the enhanced premium tax credits under the Inflation Reduction Act. If Congress does not extend these provisions, actual subsidies may be significantly different from estimates shown.

Non-ACA plan information (short-term health insurance, fixed indemnity, supplemental insurance) reflects general market conditions. Actual plan availability, pricing, benefits, and exclusions vary by state and carrier.

Always verify specific plan details with the insurance carrier or a licensed agent before enrolling.

10. Intellectual Property

All content on this Site — including text, graphics, logos, design, layout, code, data compilations, and software — is the property of HealthcareSeeker or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, reproduce, distribute, or republish any content from this Site without our written permission

WE DO NOT WARRANT THAT THE COST ESTIMATES, SUBSIDY CALCULATIONS, OR PLAN COMPARISONS DISPLAYED ON THE SITE WILL MATCH THE ACTUAL COSTS, SUBSIDIES, OR PLANS AVAILABLE TO YOU. THESE ARE ESTIMATES ONLY.

HealthcareSeeker is not affiliated with or endorsed by the United States government, the Centers for Medicare & Medicaid Services (CMS), the Department of Health and Human Services (HHS), or any state health insurance marketplace or exchange.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEALTHCARESEEKER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES
  • DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE
  • DAMAGES ARISING FROM ANY INSURANCE POLICY YOU PURCHASE OR FAIL TO PURCHASE BASED ON INFORMATION FROM THE SITE
  • DAMAGES ARISING FROM THE ACTIONS OR OMISSIONS OF OUR INSURANCE PARTNERS, AGENTS, OR OTHER THIRD PARTIES

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any information you submit through the Site that is false, fraudulent, or misleading
  • Your infringement of any third-party rights

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.

  • Each party shall bear its own costs and attorneys' fees, unless the arbitrator determines otherwise

Opt-Out of Arbitration

You may opt out of the arbitration agreement by sending written notice to legal@healthcareseeker.com within 30 days of first using the Site. Your notice must include your full name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in [Your State].

Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdiction.
